could you please proofread the following sentence:
XY nor his defence counsel, as the case may be, was allowed to inspect the file, because XY could not have been served the order on commencement of the prosecution in the USA and called to witness up to now, which means that he has no procedural status in this criminal procedure and has still been only suspected.
