Neither XY nor his defence counsel was allowed to inspect the file, and because XY could not have been served the order[What kind of order was this?] on commencement of the prosecution in the USA nor has been called as witness up to now, he has no procedural status in this criminal trial.
Without full context, this is guesswork, but would make sense.
