Post present simple/continuous with "when"/"while"

Hello.............

Which is correct? "While she is drinking her chocolate, she often watches the people who are walking by in the street." or "While she drinks her chocolate, she often watches the people who walk by in the street." Or are both possible, but express different things? Is there any rule for what to use with "when" and "while"?

Try,

While drinking her hot chocolate, she often watches passers-by.
She often watches passers-by while drinking her hot chocolate.

Let's rent a car (we do the driving), tux, an apartment.
Let's hire that person, a car (we hire the driver's services).
