Judicial sentences are often unclear or incomprehensible. The law provides resources to fix these problems, within a certain period. Frequently, however, the problem is detected only when the parties attempt to require compliance with the ruling and there is no longer resource available for the clarification of its meaning. When the meaning of a sentence is unclear, one must know how to deal with it. In particular, it is needed to know how preclusion and res judicata relates to it. This thesis presents a theory based on the varying degrees of obscurity a court ruling can achieve, and on the differences between the acts of creation, interpretation and enforcement of judgments. Based on these distinctions, some solutions are proposed, always in the light of brazilian civil procedural law.
