On the evidence

The State has effectively limited access to private health care except for the very rich, who can afford private care without need of insurance. This virtual monopoly, on the evidence, results in delays in treatment that adversely affect the citizen's security of the person.

1. on the evidence - does it mean something like 'based on the evidence'? and what evidence?

2. security of the person - the person is the citizen mentioned, right? couldn't he have said '...the citizen's security' and stop there? or am I wrong on this one?
