forfeited to/by the government

Police said that if the money legitimately belongs to the man, it would be returned to him. If the cash is proceeds from a crime, it will likely to be forfeited to the government.

Is 'forfeited to' correct? Should it not be 'forfeited by'?

"The money will be forfeited by the man."

"To" is for the party receiving the forfeiture.
"By" is for the party losing the forfeiture.
