Could anyone help me rewrite the two underlined phrases?

As for the first one, I was trying to add a modifying phrase to " the spouse" but I don't know how it scans and, for the second one, I am not sure whether "exercising visitation" is a legitimate expression.

I am sensing taking out " 's " to mean "the spouse (who is) exercising visitation"
might be a better idea.

What would be the experts' take on that?
