Not a teacher. You may have come across the saying "You have the right to remain silent.".
So have the right is right and you could also say have got the right but not only got the right.
This is my humble opinion as a learner of English. Wait for the teachers to respond to be 100 % sure.
EDIT: just saw it: failure: the question was about "have that right". Now I refer to my right to remain silent.
