Hello Kahhong,

1. Terms and conditions apply. <verb>
2. Terms and conditions are applied. <past participle>

Note that, past participles have two functions. They can function as an adjective;e.g., applied linguistics, or as part of a verb; e.g., the present perfect: I have applied the glue; the passive: Terms and conditions are applied.
