Is the follwoing sentece correct in terms of tense? ( I am trying to describe something happening at the moment of speaking)

I am waiting for a bus. One boy is eating a sandwich while wating for a bus. He doesn't seem to have eaten breakfast. ( is it right tense???)

The tense is fine, but the main verb seems doesn't work. Try,

One boy is eating a sandwich, and you can tell by the way he is eating it that he hasn't had/hasn't eaten breakfast.

what I am trying to say that I am not sure whether he has eaten his breakfast or not. That is why I chose " seem", so in such case, can I

maybe he has not eaten his breakfast??
