    can "as" be omitted in the first sentence? why?

    The first sentence is correct. Omit 'as' from the second sentence and you'll have TWO correct sentences.

    I would choose the second one instead.
    As "As" in the sentence is a conjunction, you cannot omit it.
    "Longman Dict." has this:
    "As- in the way that someone says or that something happens, or in the condition something is in. For example,
    Do as I say!
    We'd better leave things as they are until the police arrive.
    The money was repaid, as promised.
    He did not need to keep moving house, as his father had."

    Do not choose the second one.

    As I have reccommended elsewhere, flip the sentence around a little and you will see the problem.

    Yours is a fine country, just as mine is.

    Everyone knows him as the fine athelete that he is.
    He became the fine athelete that he is through hard work.
    (you may omit "that")

    You cannot say: "He became the fine athelete as he is."(x)

    Or break down the sentence into a more basic structure and the error is evident.

    "Australia became the modern country as it is."(x)

    "as it is/does" means "the way it is/does"

    I wish I could think of a simple rule or litmus test, but none come to mind immediately, perhaps someone else can do it.
