Hello, I would like to know whether the following beginning of an answer in essay form is correct:

Under the Administration of Estates Act 1975, the estate would be distributed as follows:

The surviving spouse and surviving children coinherit.

Is it right to introduce the topic using a tense different from the one that prevails in the rest of the answer, that is, I started the answer using a hypothetical structure with the modal verb "would", and then, I used the present tense?

The Estates Act is not hypothetical.

Under the Administration of Estates Act 1975, the estate will be distributed as follows:

The surviving spouse and surviving children coinherit.

If the situation were hypothetical, I would recommend that the remainder of the writing that refers to the hypothetical situation be in the subjunctive mood.

If the Estates Act had been passed, the surviving spouse would inherit.
