Should we use the word "deemed" in passive or active voice?

For example which of the following senteces is correct.


1- The contract deemed to be extended for 1 year with the same terms and conditions

2-The contract is deemed to be extended for 1 year with the same terms and conditions

In this context, the second is correct.
