As dictionaries tell this phrase occurs in formal documents.

I think being is a participle (not a gerund) here but I'm not sure.
Am I right?

I agree with you. It is not acting as a noun (gerund). It is acting as a modifier (participle).

They are both extremely ugly constructs.
