    Use of "the" or not?

    Hello all,

    I hope someone can help me with this problem.
    When writing about breach of rules, breach of duty etc, should I use "the" or not?

    For example: "Serious breaches of (the) duty of loyalty towards the employer can constitute grounds for termination."
    Or: "If notice of termination due to shortage of work is given in breach of (the) rules regarding employment is given to an employee..."

    They are correct either way. I'd omit 'the' for the first sentence and use it for the second.

    May I ask why you'd omit 'the' in the first sentence?
    Is it the plural of the word breaches, the word "duty" as opposed to "rules", because it is a shorter/simpler sentence or something else?

    "Breach of duty" is a common expression; "breach of rules" is not so common. They just sound more natural to me; there's no grammatical justification. As I say, both are correct.
