    Arising

"Within three months of the dispute's arising" sounds terrible. Is there a better-sounding option?

"In the event that the Parties are unable to reach a solution within three months of the dispute's arising, the dispute shall be definitively settled under the rules of the International Chamber of Commerce in force on the date when the Notice of Arbitration was submitted."

    Thanks!

Maybe "beginning/origin of the dispute" would be better.
