In the past few years, many same sex couples are facing the issue that one of them cannot adopt their partner’s biological or adopted child legally because some states do not grant the legal status of spouses to same-sex partners. Second parent
adoption is a legal procedure that allows couples to adopt their partner’s biological or adopted children. These procedures ensure that both partners are considered legal parents of their child; consequently, they obtain legal equal rights of the child. Second parents adoptions give the child two legal guardians who have the right to live with a child, full or part time, and make decisions about the child’s health, education, finances,support, and well-being. Even though in some states singles gays and lesbians are allowed to adopt a child, in other states gays and lesbians cannot adopt or be foster parents of a child because of their sexuality. Although gays and lesbians have been able to individually adopt children in many states, partners of gay, lesbian, adoptive or biological parents have been unable to adopt the children they are raising together. It is in society’s best interest to look for the best interest of a child; therefore, the children ofsame sex couples deserve the legal protection of a two- parent, whomare going to provide love, safe, and financial support.
 
Children born too or adopted by one partner of a same sex couple deserve to be
legally adopted by the other partner and have the legal protection of two legal parents who are going to love, protect and offer them a home regardless of their sexual orientation. The American Academy of Pediatrics states that” children born to or adopted by a parent in a same-sex couples have the right to be adopted by their non legal parent, entitling them to custody, visitation, and child support, as well enjoy the health benefits and Inheritance rights from both parents“. When a child has two legal parents, they have protective rights, health care, financial support, and the right of inheriatance.. For example, if one parent has a disability or dies, the child has the right to receive social security benefits. Many gay couples are great people who have the desire to adopt biological or adopted children of their partner or just by themselves to provide a loving and a positive environment for their children. They want to express love, affection, help them feel safe, and be a good role model for them so children can have a good childhood and become good persons in the future. Moreover, by allowing same sex couple or single gay or lesbian adoption, many children in foster care are going to have a home with a family who is going to
take care of them.
