    make a sentence with "marking"

    Are both sentences correct?

    The cone in the photograph is marking the spot where the accident occurred.

    or

    The cone in the photograph marks the spot where the accident occurred.

    I think they're both correct, but the second one is more elegant.

    I would use the second. The first is OK, but as the cone is fixed in the photo, the present simple works better for me.
