    Shouldn't "nor" be "or"?

    No. In my opinion, "not making" should be "neither making".

    (The) respondent is neither making (a) legitimate non-commercial nor fair use of the disputed domain name".
    Remember - if you don't use correct capitalisation, punctuation and spacing, anything you write will be incorrect.
