    in the fact!

    Is it wrong to use "in the fact" in the following context? Or should it be "in fact"?

    The first mention of slavery in the statutes of the English colonies of North America does not occur until after 1660, some forty years after the importation of the first Black people. Lest we think that slavery existed in the fact before it did in the law, Oscar and Mary Handlin assure us that the status of Black people down to the 1660s was that of servants.

    It's OK. You have to look at the whole phrase "... slavery existed in the fact before it did in the law".

    The existence (fact) of slavery predated the usage of the term in law. People had been using slaves before slavery became a recognised legal thing.
    Remember - if you don't use correct capitalisation, punctuation and spacing, anything you write will be incorrect.
