    Can I use the second one if I'm for sure planning to stay at the apartment?

    Whether you are "for sure" or not doesn't make any difference.

    Either:

    Would it be OK if I stayed...

    Or:

    Will it be OK if I stay...

    And it can't be "at apartment." "At the apartment with you" or simply "at your apartment."
