    Its already past the tfl

If I am talking to the insurance rep regarding a claim and rep tells me that they never received that claim. The claim was for the month of october of 2014. Then rep tells me that we had to submit it within 120 days from the date of service, so the timely filing limit was 120 days. So is it right to say to her that "Its already past the timely filing. What should we do now?" or "120 days have already passed so what do we do now?"or "Its already been more than 120 days since our submission. What to do now?"

    That could be a problem.

    Say:

It's already past the timely filing date. What should we do now?

    or

120 days have already passed, so what do we do now?

    or

It's already been more than 120 days since the date of service. What should be done now?

Use one of them, and tell them that you really did send your claim in plenty of time, but for some reason they didn't get it when they should have.
