    could you please tell me what "beside performance" means in the following sentence:

    All contractual penalties are independent of the actual damage incurred and may be claimed beside performance.

    My guess, and it's a guess because I am not familiar with the kind of language used in contractual law, beside performance could mean either in addition to or next to.

    Usage note beside - Definitions from For the prepositional meanings “in addition to” and “except” besides is preferred, especially in edited writing: ... However, beside sometimes occurs with these meanings as well.
