What does it mean in your opinion?

Does "XX has to apply for the ​periodic audits as agreed ​on (or upon) with CC" mean the same as "XX has to apply for the ​periodic audits that ​were agreed ​on (or upon) with CC"? Yes.

What does it mean in your opinion? ​CC and XX agreed on a periodic audit, and CC has to request it.
