Could you please explain this structure which starts with the participle?

Given my past record, it seemed unlikely that my abilities would improve in the future.
Being asked why he is late, he hesitated to respond.

For the second, I would use either:

Asked why he was late, he hesitated to respond.
When asked why he was late, he hesitated to respond.
