Which one is correct?

There is also an instance that shows how people react differently towards immoral actions in society, depending on the wrongdoer’s gender: whether a man or a woman. Both Henry and Helen had/have had sexual indiscretion; however, “[Henry] remain in society, Helen can’t. [He has] had only pleasure, she may die” (Forster 274).

I think the correct answer would be have, because it's about the action that has the consequences in the present. For such actions, we use the Present Perfect Tense.

Your statement is well understood but it can be expressed in good English. Although incorrect, the short phrase Me too is accepted as a follow up expression in discussion. So you could say:
I too think, ‘have’ is correct. Or Me too! my thinking is ‘have’.

You should omit the redundant ": whether a man or a woman."

If the reaction depends on the gender of the wrong-doer, then it obviously depends on whether they are a man or woman.
