Hypothetical future or past situation

Can you have a look at the following text?
"The Unfair Terms in Consumer Contracts Directive18 is one of the most important consumer-protecting legal instruments in the European Union. Although drafted and enacted before the onset of the Internet age, its application to Internet cases and its importance for online transactions is well established. The aim of the Directive is simple: to minimize or eliminate unfair clauses in consumer contracts. The Directive had its origin in the Commission’s policy of providing a comprehensive consumer protection system which would extend to civil contracts."
Is it clear from the text that "would extend" refers to the past (not realised) hypothetical situation instead of the future hypothesis (or general statement like such a scenario can be a case)? What would be grammar or contextual arguments in support of either view?
