The topic is some say that illegal downloading from the internet is not different to theft and should be punished by imprisonment ,not fines.

Why do you want to say it is like theft? While it is highly unpleasant and causes people not to make money, it doesn't involve taking money or something away from them, IMO, but preventing them from earning more.

But if you are an author who relies on royalties for income, and someone illegally [without permission] downloads your text and then sells it on, is this not a form of theft?

I colpmletely agree with the idea that the word theft can be used.

Here is the logic of my explanation;

Theft:act of taking another's property without permission.

Today in the law we have a major called "intellectual property"

Downloadable items are generally part of the intellectual property

In terms of theft I think inellectual property and any other personal property has no difference Therefore, I think;

Act of taking another's property including intellectual property consequently the downloading the items illegally that is the property of someone can be considered as theft.

Is the property taken if it is copied? I am not saying it is right, but I am not entirely happy that it is synonymous with theft. If I make a copy for myself and do not sell it, I have breached copyright, but I have not removed the property; it's still there.

If we are talking about the intellectual property, where it is?

In that case I think the right that represents the actual property is taken and it is used without the permission of the legal right owner, since taking the intellectual property is physically impossible.

Similar example can be given about moveable properties.

A car key represents the property right of a car. If somebody stole a car key, he would be accused of stealing the car though the car is still in the owner's garage.

Whatever people put on public that is belong to public, and "A FACT", people may enjoy, criticize, copy or memory for their own as they like, but no reproduction until they get a permission from the author. According to LwyrFirat's case is so different. Because the car's key is a private of someone, so please do not bring the private thing to compare with the public thing.

My feeling is that the author's response and the user's response will differ.

To the author, it will be theft if he/she receives no recompense for the work when it is downloaded without payment UNLESS it is made clear that downloading is a free service.

The user will take anything he/she can and the consequences are immaterial.

I think you completely misunderstood my response. There is no connection between your comment and my example. I just wanted to show to Tdol that without taking the actual property theft can be occured.

Also, I disagree with your opinion, the author of that downloadable item doesn't want to make it public, someone else makes it public without his/her permission. Actually the copyright supposed to be personal, it's not my opinion it's a law so there is no meaning to even discuss it, it's legally compulsory to accept this fact.

By the way please do not misunderstand , I don't mean this action is legally theft. Of course it is not, in law terminology it is called "copyright infringment". However I believe, the usage of the word theft in daily language can be applied for that case.

I agree that it's OK to use it in daily language. However, it is possible to take the actual intellectual property; if I broke into your laptop, copied the file and deleted your version, then that would be a more serious issue and represent a loss. By the way, I am not in favour of copying; stuff gets 'stolen' from our site; we spend ages building lists and glossaries and then they appear uncredited on other sites.
