And Justice for All illustrates how our criminal justice system can be unjust. These illustrations include: where an innocent man is sentenced to jail time on a technicality, a case in which a citizen that should receive probation receives jail time due to an attorney’s negligence, and situation where what is morally right is not legally right. And Justice for All is a movie that portrays the negative side of our criminal justice system and how individuals can be affected by the end results.
In the first situation Attorney Arthur Kirkland takes on a case in which the client is obviously innocent. Attorney Kirkland’s client, after being pulled over for a broken tail light, was arrested because he had the same name and fit the description of a wanted man. Attorney Kirkland compiled the evidence to prove his client’s innocence and presented it to the judge. However, the judge, having no sympathy for the client, chose to strictly abide by the law which states that the evidence was not provided in the amount of time set forth in the law and he did not allow any exceptions to ensure this client was released from jail in a timely manner. Attorney Kirkland assured his client that he would continue to work on his case and get him out of jail. The client having little hope and enduring torture from inmates in the jail eventually suffered some type of mental break. While still incarcerated, the client managed to take hostages by gunpoint with ended with his death. Sadly, if this man had been released from jail like he should have been this tragedy would have never occurred. Innocent individuals have been sent to jail many times and it will continue. The criminal justice system is no where near perfect.
In the next situation an inmate requested Attorney Kirkland’s services so that he may receive leniency for a crime. The client was an accomplice in a robbery. The client was found guilty in court, however, Attorney Kirkland assure the client that with this being a first offense and his ties to the community he would only receive probation. Unfortunately before the sentencing hearing for this client an emergency occurred and Attorney Kirkland wouldn’t be able to attend the sentencing. Attorney Kirkland asked a fellow attorney to go in his place and present the materials he had provided. The attorney that Kirkland sent to the sentencing hearing acted irresponsible. The attorney arrived late and presented nothing to the judge. The client was sentenced to jail time. Due to this attorney’s negligence, an extremely short time after being locked up the client committed suicide. A man’s life would have not ended if he would have been correctly represented. If an attorney does not act in the client’s best interest it is easy, if not definite, to be given a more harsh punishment.
In the final situation a judge requests that Attorney Kirkland represent him in a case where he is accused of rape. Attorney Kirkland has no interest in representing the judge for this is the same judge that sent his innocent client in a previous case to jail with no remorse. However, it was brought to Attorney Kirkland’s attention that if he did not take the case that the judge, with his political pull, would ruin his career. After deciding to take the judges case the judge admits that he is guilty of beating and raping the victim. Attorney Kirkland is now faced with a dilemma. He contemplates if this guilty judge, who put his innocent client in jail, should be set free. At the judge’s trial Attorney Kirkland tells the court that the judge admitted to committing the crime. I am sure they declared a mistrial for the judge and he was set free, but everyone would know what kind of man the judge was and possible relieve the judge of his position. Also, as a result, Attorney Kirkland will be disbarred, but he would have a clear conscience. Clearly what is ethically right and wrong is common sense, however; in some circumstances it is not legally just.
And Justice for All is a virtuous example of the injustices in our criminal justice system. The movie provides demonstrations of some of the activities that go on in our courts, innocent citizens incarcerated, harsh punishments for poorly represented individuals, and the ethical values verses legal statues. And Justice for All opens the eyes to some that believe that the criminal justice system is flawless.
