use of despite

Hi I want to know if this sentence is written correctly: "Despite of there could be some cases of people who might have not being treated nicely, native people are kind to outsiders" This sentence is from a text comparing living in other countries...my question is about the use of despite, should I better say: "Despite the fact there could be....."??

"Despite" + [noun phrase], [clause].
Despite their lack of experience, they were good tennis players.

why don't say: Despite their lack of experience, they are good tennis players?

or

Despite they are lack of experience, they are good tennis players?

I am so confused about time tense.
