If the waiter brings the size considered small there, then that should be good enough. If the customer is really dissatisfied, then they can complain, but most people would accept it.

If it's not big enough, you can order a refill, or the next larger size. Depending on the establish and the beverage in question, refills are often free in many US restaurants, although juices (and alcoholic beverages) are usually the exception.

If you consider it too big, then there's nothing do be done as it's already in their smallest glass.

A couple of days ago I was served a sixteen-ounce glass of fresh-squeezed orange juice at a hotel's breakfast buffet. This was just part of the regular service, so it was neither a "small" nor a "large" glass. It was far more than I would normally drink, but I couldn't stand to see any of it wasted so I finished it off.
