I assume:

1. "..., nor be otherwise circulated in any form of binding or cover ..."
can be interpreted as
" , and no part of this publication be otherwise circulated in any form of binding or cover ...".

2. "That" refers to "binding or cover".

3. "It is published" (rather than "it was published") suggests copies of this book were still being sold (at the time when the text was written).

2. Yes, it refers to the binding.
3. It doesn't make any statement about whether the book is still being published or not. (The standard text used for this is obviously first used before ANY copies have been sold.)

I think it is a general statement, so the present simple (it is published) is appropriate. Do you agree? :)
 
I think Matthew's interpretation is fine- I think that you cannot copy a book that is out of print until it is out of copyright.
