1) Tom has never cried when people are around him.
2)Tom has never cried in public or alone.
3) Tom has never cried alone.

What do we use "past tense" or "present tense" in the second part of the sentence? Like "Tim has never cried when someone was around or is around him"?

What do we use missing word "past tense" or "present tense" (unnecessary punctuation around the names of tenses in the underlined part) in the second part of the sentence? Like "Tim has never cried when someone was around or is around him"? (Incorrect layout. If you're giving us two options, put them in separate example sentences.)

I thought so because I used the present perfect. Which tense should be used?

Given the statement above, 5jj's response below answers your question completely.
Then that is all you need to say.
There's no need for the extra information you put in post #1 - the presence of other people is completely irrelevant if he's never cried.

I would say that's present perfect. (The tense that was used.)

He has never cried - present perfect

(Somebody will correct me if I'm wrong.)

I would like to know what tense should follow? It is going to help me with other scenerios as well. Should it be "other people are or were around"?
 
The only way you can know that somebody has never cried is if you are that person. (That's if it's a real person. You could "know" that about a fictional character.)

I'd use the past tense in the when-clause, especially if the adverb before were added to the main clause:

Tom has never cried before when people were around him, so I'm surprised to see him crying so publically now.

That sentence would sound wrong to me with are instead of were in the when-clause
 
That mix of present perfect and past simple does not work for this speaker of BrE.
