Which one is correct?

1. Neither you nor he is to blame.
2. Neither you nor he are to blame.

With #1 are you less likely to be stoned to death by people who think the language belongs to them. Talking about the damned-if you-do-and-damned-if-you-don't issues of grammar. :)
 
Does this mean number 1 is incorrect, and number 2 is the correct one?

2. Neither you nor he are to blame. :cross:
