I think in #2 it is clear that the agent of 'swearing vociferously' is 'he'. He habitually swears vociferously.
In #1 the agent of 'swearing' might be 'he', but it might not. Maybe he is used to being sworn at, or maybe he is used to hearing other people swear at each other.
Would you say that is correct?
