If a business date of termination is 05 Jan 2021, is the business still operating on 05 Jan 2021? I assume it means the last day of normal business is 05 Jan 2021, and it will close from 06 Jan 2021 onwards?

Thanks.

It's impossible to be certain without more context. As it stands, the business might operate all day on January 5, part of the day, or perhaps even not at all. All we know for sure is that it will be permanently closed by January 6.

I'd say that if the termination happens on the fifth, the business is terminated on the fifth. A terminated business is not operational.

A careful lawyer would probably word the sentence more carefully because of the ambiguity you've pointed out.

Yes, if the termination is on the 5th, then the business stops working that day. If the sentence was something along the lines of "we're working until the 5th", it'd be much more ambiguous, but here, you'd be better off assuming that the 4th is the last day to work with this company.
