Do I use is or was in this sentence?

Sheila was involved in a car accident yesterday and the driver who drove his vehicle into her vehicle was responsible for the accident. She is not at fault.
 
"Was" if the reference is to yesterday's event and she may or may not have been judged by some authority as without fault. "Is" if she has been judged by some authority as without fault.
