According to some definition of "pending" in a dictionary (--> learnersdictionary.com/search/pending <--) :

---"while waiting for (something) "

So, for a generic sentence "X pending Y", "X" must be either an activity or a state. So this sentence is good:

"He was out on bail pending trial."

because "he was out on bail" is a state/activity. Then, would the following be a bad usage of "pending":

---"There are currently 32 Development Agreement applications pending review"
(--> smgov.net/departments/council/agendas/2013/20130108/201301085-A.htm <--)

since "applications" are not a state/activity. "Applications pending review" does not fit the generic form "X pending Y".

The definition in your suggested dictionary reads "while waiting for". That "while" implies that in the usage pattern "X pending Y", "X" must be something that is happening, which further implies that "X" must be a state or activity. I might be wrong though...

Hmm, I could have sworn the dictionary read something like this:

pending [ˈpɛndɪŋ]prepwhile waiting for or anticipating

adj (postpositive)1. not yet decided, confirmed, or finished what are the matters pending?
2. imminent these developments have been pending for some time
